Branding is the perpetual process of identifying, creating, and managing the cumulative assets and actions that shape the perception of a brand in stakeholders’ minds.

Branding is important because not only is it what makes a memorable impression on consumers but it allows customers and clients to know what to expect from the company. It is a way of distinguishing yourself from the competitors and clarifying what it is you offer that makes you the better choice.  Brand is built to be a true representation of who you are as a business, and how you wish to be perceived.

 

Importance of Branding

 

Types of Branding

  • Brand Name
    A word, name, symbol, etc., especially one legally registered as a trademark, used by a manufacturer or merchant to identify its products distinctively from others of the same type and usually prominently displayed on its goods, in advertising, etc.
  • Brandmark
    A brandmark is a symbol, element, art design or visual image that helps immediately recognize a certain company. It is essential for developing and maintaining a brand’s name.
  • Trademark
    A trademark includes any device, brand, heading, word, letter, numeral,packaging, or combination of colors or any combination thereof which distinguishes the goods or services of one person from those of others.

In Nepal, Trademark is mostly used for branding.

Trademark serves two important purposes:

  • It protects the public from confusion and deception by identifying the source or origin of products as distinguished from other similar products; and
  • It protects the trademark owner’s trade and business as well as the goodwill which is attached to the trademark.

Procedure of Trademark registration

Step 1: Submission of an application for registration of a trademark to the Department of Industry.

Step 2: Preliminary examination of the application by the Department of Industry.

Step 3: Publication of trademark in the Industrial Property Bulletin (IP Bulletin).

Step 4: Registration of the trademark.

  1. Application form in the prescribed format.
  2. Incorporation Documents(AOA, MOA)
  3. Industry Registration Certificate
  4. Company Registration Certificate, in case of a company.
  5. PAN Registration Certificate
